The distinction between an independent contractor and an employee is not always easy to determine. However, the risks are high if you misclassify your workers. Your business may be subject to audit by the Internal Revenue Service, state tax agencies, the Department of Labor, as well as state labor agencies, and misclassifying a worker could result in litigation, penalties, and back pay that can have a catastrophic impact on your business. This presentation will address the differences in the classifications between independent contractors and employees and will help employers determine how to classify workers when looking to hire help.
